By accessing or using our website, patient portal, telehealth services, or visiting any of our physical locations, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. These Terms constitute a legally binding agreement between you and NextGenHealthHub regarding your use of our healthcare services, digital platforms, and any related communications.

1. Acceptance of Terms

By scheduling an appointment, completing a patient intake form, or browsing our website, you acknowledge that you have read, understood, and agree to comply with these Terms, our Privacy Policy, and any additional guidelines or rules applicable to specific services. If you do not agree with any part of these Terms, you must immediately discontinue use of our website and refrain from seeking services from NextGenHealthHub. We reserve the right to update or modify these Terms at any time without prior notice. Any changes become effective immediately upon posting. Your continued use after changes indicates acceptance of the revised Terms.

2. Medical Disclaimer & No Emergency Services

NextGenHealthHub does NOT provide emergency medical care. If you are experiencing a life-threatening condition, severe bleeding, chest pain, difficulty breathing, or any medical emergency, call 911 immediately or go to the nearest emergency room. Information provided on our website, via chat, or through telehealth is for general informational and educational purposes only and does not constitute a medical diagnosis or prescription. Always consult a qualified healthcare provider in person for specific medical concerns.

Our clinicians strive to provide accurate diagnoses and treatment plans based on the information you provide. However, telemedicine and remote consultations have inherent limitations (e.g., inability to perform physical examinations). You are responsible for providing complete and accurate health information. NextGenHealthHub shall not be held liable for any adverse outcomes resulting from incomplete information, technical failures, or your failure to seek in-person care when advised.

3. Patient Eligibility & Account Registration

To receive medical services, you must be at least 18 years old or be accompanied by a legal guardian. For minors, a parent or legal guardian must accept these Terms on behalf of the child and provide consent for treatment. You agree to provide truthful, accurate, and complete registration information (including identification, insurance details, medical history). You are responsible for maintaining the confidentiality of your patient portal login credentials. Notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate access for any fraudulent, abusive, or disruptive behavior.

4. Telehealth & Digital Services

Our telehealth services are provided through a secure, HIPAA-compliant platform. You consent to receive virtual consultations, electronic prescriptions (where legally permissible), and remote monitoring. You understand that:

  • Telehealth may involve transmission of your personal health information via the internet.
  • Despite encryption, there is a minimal risk of data interception.
  • You must have a suitable device, stable internet connection, and a private environment for the consultation.
  • In certain situations, the clinician may determine that an in-person visit is necessary; if you refuse, we may decline to provide care.

Recordings of telehealth sessions (with your explicit consent) may be used for quality improvement and clinical documentation only. You may withdraw consent at any time, but it may affect service delivery.

5. Appointments, Cancellations & No-Show Policy

We understand that schedules change. To ensure access for all patients, we enforce a reasonable cancellation policy:

  • Cancellations: Please notify us at least 24 hours before your scheduled appointment to avoid a cancellation fee ($35 for general visits, $70 for specialty procedures).
  • No-Show: Failure to attend an appointment without prior notice may result in a no-show fee of up to $85 and may affect your ability to book future appointments.
  • Late Arrivals: If you arrive more than 15 minutes late, we may need to reschedule, and a late cancellation fee may apply.
  • Exceptions: Emergencies, severe weather, or verified technical issues (for telehealth) may waive fees at our discretion.

We send appointment reminders via SMS, email, or phone; however, you remain responsible for remembering your appointment times.

6. Fees, Payments & Insurance

NextGenHealthHub offers transparent, upfront pricing. Our service fees are detailed on our services page. You agree to pay all charges incurred for services rendered, including consultations, procedures, lab tests, and any applicable facility fees. Payment is due at the time of service unless prior billing arrangements have been made. We accept cash, credit/debit cards, HSA/FSA, and most major insurance plans. For insured patients, you are responsible for co-pays, deductibles, and any amounts not covered by your insurer. We provide a “good faith estimate” upon request, but final charges may vary depending on unexpected complexities. Unpaid balances after 60 days may be sent to a collections agency, and you agree to pay all reasonable collection costs and legal fees.

7. Prescriptions & Refill Policy

Our providers may prescribe medications when medically appropriate. Prescriptions are sent electronically to your preferred pharmacy. Controlled substances are subject to state and federal regulations; we may require an in-person visit for certain medications. Refill requests must be submitted at least 72 hours before your medication runs out. We do not guarantee refills without an appropriate follow-up evaluation. You acknowledge that misuse of prescription medications or “doctor shopping” will result in immediate termination of the provider-patient relationship.

8. Intellectual Property & Content Usage

All content on the NextGenHealthHub website, including text, graphics, logos, images, icons, software, and educational materials, is the property of NextGenHealthHub or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view, download, and print a single copy for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content without our express written permission. Unauthorized use may result in legal action. “NextGenHealthHub” and our logo are registered trademarks.

9. Prohibited Conduct

While using our website or services, you agree NOT to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
  • Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or invasive of another's privacy.
  • Attempt to gain unauthorized access to our systems, patient data, or interfere with the proper functioning of our website.
  • Use any robot, spider, scraper, or other automated means to access our website for any purpose without our prior consent.
  • Harass, threaten, or abuse our staff, providers, or other patients.

Violation of these prohibitions may result in immediate termination of services and legal remedies.

10. Limitation of Liability & Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGENHEALTHHUB, ITS AFFILIATES, PROVIDERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. OUR WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

⚖️ Jurisdictional Notice
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This agreement is governed by the laws of the State of Texas, without regard to conflict of laws principles.

11. Indemnification

You agree to indemnify, defend, and hold harmless NextGenHealthHub, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of our services, including any negligent or wrongful act; (c) any content or information you provide; or (d) your violation of any third-party rights. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

12. Termination & Suspension

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will cease immediately. If your provider-patient relationship is terminated for cause (e.g., violence, fraud, non-payment), we will provide a 30-day supply of essential medications (where safe) and facilitate transfer of your medical records to another provider upon your written authorization. You may terminate the relationship at any time by providing written notice.

13. Dispute Resolution & Binding Arbitration

To expedite resolution and reduce costs, any dispute, claim, or controversy arising out of or relating to these Terms or your use of NextGenHealthHub services (except for small claims court matters) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Travis County, Texas, and judgment on the arbitration award may be entered in any court having jurisdiction. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes will be resolved on an individual basis only. If any portion of this arbitration clause is found unenforceable, the remainder remains in effect.

14. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice-of-law principles. For any matters not subject to arbitration (including injunctive relief), you agree to submit to the exclusive jurisdiction and venue of the state or federal courts located in Travis County, Texas. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15. Entire Agreement & Severability

These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices published by NextGenHealthHub, constitute the entire agreement between you and us regarding the subject matter hereof and supersede all prior agreements, understandings, or representations. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
